Unmanned Aerial Systems (UAS)

Recreational operations are classified by the FAA as those conducted for recreational or hobby purposes only. There can be no commercial, business or financial benefit associated with the operation. Operators seeking to fly their drone for recreational purposes should refer to FAA guidance for recreational users HERE.

Operations for commercial or business purposes are classified as “commercial UAS operations” and subject to the requirements set forth in Federal Aviation Regulations (FAR) Part 107. Operators seeking to fly their drone for commercial use should refer to FAA guidance for commercial operators HERE.

Note: The FAA may require Commercial Operators to complete a waiver process when seeking to operate a drone contrary to the rules prescribed in FAR Part 107.

Recreational and/or commercial drone operators MUST NOT operate within the controlled airspace of RSW or FMY without first obtaining FAA authorization.

Authorization can be obtained through the following methods:

1. Low Altitude Authorization and Notification Capability (LAANC)
2. FAADroneZone (Allow 90 days for approval process)

Flying drones in certain airspace is NOT allowed. Classes of airspace and flying restrictions can be found on the FAA’s B4UFLY webpage.
